In order to provide you with the best possible experience, it is important to us that you know exactly what services we provide, what we are responsible for and what obligations you have towards our establishment. PENSION

1. CONCLUSION OF CONTRACT

1.1.            The contractual partners are Pension Schmidtburger Hof and the customer/orderer. The contract is concluded as soon as the room(s) is/are ordered and confirmed in verbal or written form and provided by the guesthouse. In the course of this, the general terms and conditions of the guesthouse are recognised by the customer/purchaser. Several customers are jointly and severally liable for all obligations arising from this contract. Group and tour organisers must provide the exact list of participants up to three weeks before arrival.

2. SERVICES AND PRICES

2.1.             The contractual services result from the details in the reservation confirmation. The agreed prices are inclusive prices and cannot be changed/reduced if products or services are not used. Any increase in VAT after conclusion of the contract shall be borne by the client. All prices are quoted in euros.

2.2.            The guesthouse may provide the guest with adequate alternative accommodation if this is reasonable for the guest, particularly because the deviation is minor and objectively justified. An objective justification is given, for example, if the room(s) have become unusable, guests already accommodated extend their stay or other important operational measures necessitate this step.

2.3.            The guest has no claim to compensation for services ordered but not utilised.

3. PAYMENT

3.1.            The hotel may demand an advance payment of 50% of the agreed price for the reservation (only 10% for arrangements and package services). If this advance payment is not received in the hotel's account within two weeks of the request, the hotel is entitled to cancel the contract. The cancellation must be communicated immediately.

3.2.            Unless otherwise agreed in writing between the partners, payment shall be made in cash, at the latest on the day of departure. If payment against invoice has been agreed, the customer must settle the invoice within 10 days of the invoice date. The customer agrees that the invoice may be sent to him electronically.

3.3.            The guesthouse is not obliged to accept non-cash means of payment such as cheques, credit cards or vouchers.

4. RETURN

4.1             Cancellation of your booking is possible free of charge up to 30 days before arrival. For room cancellations from 30 days to 8 days before arrival, we charge a cancellation fee of 50% of the booked services. In the event of cancellation at short notice within 7 days prior to arrival, we will charge a cancellation fee of 80% of the booked services. If the guesthouse has incurred additional costs due to the order, these are to be reimbursed in full by the customer.

4.2.           Group reservations of 5 rooms or more can be cancelled free of charge up to 80 days before arrival. For room cancellations from 80 days to 15 days before arrival, we charge a cancellation fee of 50% of the booked services. Cancellations made at short notice from 14 days before arrival will be charged at 80% of the booked services. If the guesthouse has incurred additional costs due to the order, these are to be reimbursed in full by the customer.

4.3.            The guesthouse may also withdraw from the agreed contract if a room option granted by the customer remains unconfirmed after repeated enquiries and other enquiries have been received. We also reserve the right to withdraw from the contract if the advance payment (3.1) has not been paid. Furthermore, the guesthouse is authorised to withdraw from the contract for objectively justified reasons.

5. ARRIVAL AND DEPARTURE

5.1.            Room occupancy is not possible before 15:30 on the day of arrival, unless other arrangements have been made in advance. Arrivals later than 18:00 must be notified to us in advance, otherwise the guesthouse may dispose of the booked room for re-letting.

5.2.           The room must be returned by 11:00 a.m. on the day of departure. If the room is available for an additional day, half the room price must be paid on departure by 6.00 pm and the full room price after 6.00 pm.

6 LIABILITY

6.1            The contractual partner of the hotel or the guest as such or as host shall be fully liable to the hotelier for any damage caused by themselves or their guests. Any use of the rooms provided that deviates from the contract shall entitle the hotel to terminate the contract without notice. This shall not reduce the entitlement to the agreed remuneration.

6.2            The hotel reserves the right to withdraw from the contract if the provision of the service has become impossible due to force majeure, without this giving rise to claims for damages.

6.3            Liability is excluded if the room or the containers from which items were stolen were unlocked.

6.4            The hotel is liable for the accuracy of the service description in brochures and for the proper provision of the contractually agreed services. The hotel is not liable for the services of the hotels it arranges, nor for third-party providers of certain arrangement services.

7. VOUCHERS

7.1            The voucher can only be redeemed for the amount paid for the voucher and expressly not for the service specified on the voucher. Payment of the voucher value in cash is excluded. The voucher can be redeemed for any Schmidtburger Hof service, subject to availability.

7.2            The voucher only becomes valid after payment.

7.3            You will receive the voucher on site or by post, usually within 3-5 working days. Please note: there is no shipping on public holidays and weekends. Delivery will be made to the person and address specified by you. We accept no liability for delays due to postal delivery.

8. FINAL PROVISIONS

8.1             In commercial transactions, the place of fulfillment and jurisdiction is the registered office of the pension: Schmidtburger Hof, Hauptstraße 20, 55627 Weiler. Verbal agreements that deviate from our general terms and conditions only become effective once the guesthouse has confirmed them in writing. Should individual provisions of these general terms and conditions be invalid, this shall not affect the validity of the other provisions. (see BGB §306)

8.2             Amendments and additions to the contract, the acceptance of the application or these General Terms and Conditions must be made in text form.

8.3             German law shall apply. The application of the UN Convention on Contracts for the International Sale of Goods is excluded.

9. ONLINE DISPUTE RESOLUTION

9.1            Online dispute resolution in accordance with Art. 14 para. 1 ODR-VO: The European Commission provides a platform for online dispute resolution (OS), which you can find here http://ec.europa.eu/consumers/odr/. However, the pension does not participate in dispute resolution proceedings before consumer arbitration boards.

RESTAURANT


1. RESERVATION AND CANCELLATION

1.1           An online reservation always requires verification on our part and is only binding upon verbal or written confirmation.

1.2           Since our restaurant only has a limited number of seats and we do not have any walk-in customers in Weiler, we ask you to contact us in good time (24 hours in advance) in the event of cancellation. For group bookings, reserved event evenings or exclusive bookings, we ask you to notify us one week in advance in case of cancellation. If this is not done in good time, we will charge an appropriate amount for services already provided in the course of preparations for the service you have reserved, insofar as the places cannot be allocated elsewhere. The same applies to no-shows on the same evening.

2. INTOLERANCES

2.1          Please inform us in advance if you have any food intolerances or allergies. Our staff will be happy to assist you on site, and an allergen list is also available. However, we are not liable for any damage to health.

3. WITHDRAWAL BY THE RESTAURANT

3.1          If the customer has the right to withdraw from the contract free of charge, the restaurant may also withdraw from the contract during this period. For example, in the event of non-compliance with an agreed and requested advance payment, which has not been made even after a grace period has been granted. 4 PAYMENTS

4.1          Payments are to be made in euros and always in cash. We are also happy to accept EC/credit card or invoice payments, provided that the necessary funds are available.

4.2          We are not obliged to accept or exchange EUR 200 bills and higher as a means of payment.

WINE

1. DELIVERY & SERVICE

1.1          The online order form only serves to request a specific product. In order for a purchase contract to be concluded, verbal or written confirmation from us is required. If the goods you have requested are no longer in stock, we will contact you immediately and look for an alternative or solution.

1.2          The delivery of goods shall be made by dispatch to the delivery address specified by the customer.

1.3          Goods that are delivered by a forwarding agent are delivered “free kerbside”. This means that the forwarding agent is not obliged to transport the goods to the door or to the customer's home.

1.4          If the transport company returns the shipped goods to the seller because delivery to the customer was not possible, the customer shall bear the costs for the unsuccessful shipment.

1.5          Collection of the goods at Schmidtburger Hof is possible by arrangement during normal business hours, unless otherwise agreed.

2. SHIPPING COSTS

2.1          Our current shipping costs are EUR 7.50. in a full 12-bottle wine shipping box by post within Germany. A shipment of less than 12 bottles is not possible, unless otherwise agreed.

2.2          For orders of 49 bottles or more, we ship by MECON forwarding agency. Here too, the shipping costs are EUR 7.50 per 12 bottles. If you prefer a different shipping company, please let us know. The resulting shipping costs will be charged separately.

2.3          In the case of shipping outside Germany, please contact us to discuss the shipping method and costs.

3. PAYMENT

3.1          We accept payment on account, but reserve the right to require new customers who exceed a value of EUR 100 to pay in advance. The issued invoice is payable within 10 days from the date of issue.

3.2          All prices are per bottle, including VAT. We reserve the right of ownership of the delivered goods until full payment of the purchase price, including any costs and interest.

4. WARRANTY

4.1          If the delivered goods are defective, the statutory liability for defects shall apply.

4.2          If you notice any obvious transport damage upon delivery, please complain to the deliverer and inform us.

5. RIGHT OF WITHDRAWAL

5.1          You can revoke your contractual declaration within 14 days without giving reasons in text form (e.g. letter, fax, e-mail) or, if the goods are delivered to you before the deadline, by returning the goods.
